These Terms of Service ("Terms") govern your access to and use of the Smash Accept website, mobile applications, and related services (the "Service") operated by Smash Accept LLC ("Smash Accept," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You agree to provide accurate information and to keep your credentials secure. You are responsible for all activity under your account.
2. Subscriptions and Billing
- Paid plans are billed in advance on a recurring basis (monthly or annual, as you select at checkout) through our payment processor, Stripe.
- Subscriptions automatically renew at the end of each billing cycle until you cancel. You can cancel at any time from your account's billing portal.
- Cancellation stops future billing. Access continues through the end of the current paid period. We do not provide refunds for partial periods, unused time, or previously charged periods. See our Refund Policy for details.
- We may change pricing or plan features. We will give you reasonable advance notice before any price increase that affects your subscription.
3. License and Acceptable Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial fantasy football activities. You agree not to:
- Reverse engineer, scrape, or copy the Service except as permitted by law;
- Resell, sublicense, or redistribute the Service or its data;
- Use the Service to abuse, defraud, or harm another user or third party;
- Interfere with the Service's operation, including by attempting to bypass rate limits, security controls, or paywalls;
- Use automated systems (bots, scripts) to access the Service without our written permission.
4. Sleeper and Third-Party Data
The Service interacts with Sleeper's public APIs to fetch your league and roster data. Smash Accept is not affiliated with, endorsed by, or sponsored by Sleeper. Your use of Sleeper is governed by Sleeper's own terms. We are not responsible for the accuracy, availability, or behavior of third-party data or services.
5. User Content
You retain ownership of any data you submit (e.g., custom rankings, notes). By submitting content to the Service, you grant Smash Accept a worldwide, non-exclusive, royalty-free license to host, store, and display that content for the sole purpose of operating the Service for you.
6. Disclaimers
The Service provides analysis and tools for entertainment and informational purposes only. It is not financial, investment, legal, or wagering advice. Fantasy football outcomes depend on many factors outside our control. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMASH ACCEPT LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE DURING THAT PERIOD.
8. Indemnification
You agree to indemnify and hold harmless Smash Accept LLC and its affiliates from any claim, demand, or damages (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service at any time by canceling your subscription and/or deleting your account.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by updating the effective date above and, where appropriate, by email or in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
